Middletown Man, 53, Faces DWI Charge After Refusing Breathalyzer

An Orange County man refused to consent to a breathalyzer following a stop by state police on Route 209 when he was allegedly drinking and driving.

New York State Police troopers stopped Middletown resident Theodore Lewis III, 53, on Sunday night on Route 209 in Mamakating for erratic operation.

Police said that during the subsequent traffic stop, troopers found the odor of alcohol on Lewis’ breath, and he proceeded to fail multiple Standardized Field Sobriety Tests. He was arrested at the scene and refused to submit to any other tests or a breathalyzer at Police Headquarters in Wurtsboro.

Lewis was arrested and charged with driving while intoxicated, a misdemeanor. Following arraignment in Mamakating Court, Lewis was released to a sober third party. He is due back in court at a later date to answer the charge.
